Generally, child solicitation is always a felony in Indiana; the question is what level. The charge will be either a Level 4 felony (more serious) or a Level 5 felony (somewhat less serious). Solicitation means commanding, authorizing, urging, inciting or requesting someone to perform certain sexual acts. Solicitation can happen in person, by phone call or text, using a computer, or through any other means. It is a Level 5 felony for a person 18 years of age or older to solicit a child under age 14 (or someone the offender thinks is under the age of 14) to engage in sex, touching, or other sexual acts, or for a person 21 years of age or older to do the same with a child who is aged 14 to 16 (or is someone the offender thinks is that age).
Either of these Level 5 felonies can become a more serious Level 4 offense for offenders who use a computer (such as to enter a chat room) and travel to meet the child or if they have a previous child solicitation conviction on their record.
If convicted of a Level 5 offense, you could face up to six years in prison and up to $10,000 in fines. If convicted of a Level 4 offense, you face up to 12 years in prison and fines up to $10,000.
